A. Accuracy Questions of the “Phraya Man’s Index”

In the interview, which the Faculty of Law, Thammasat University, arranged in 1980 to 81, the main figure of the drafting of the current Civil and Commercial Code, Book I and II (1925), พระยามานวราชเสวีม, made following remarks:

... “ดังนั้นประมวลกฎหมายของเราจึงถูกเปลียนจากชีวิลโค้ด (แบบฝรั่งเศส) มาเป็น แพนเด็กต์โต้ด (Pandect Code) แบบเยอรมัน แต่เราก็ตัองรักษาน้ำใจของฝรั่งเศสเอาไว้ โดยเราเอาเค้าโครงแบบเยอรมัน แล้วเอาโพรวิชันของฝรั่งเศสเป็นบางตอน เวลาร่างกฎหมายฉันก็บอกว่าอันนี้เอามาจากกฎหมายญี่ปุ่น อันนั้นสวิส อันนั้น Old Text ที่กรรมการชุดก่อนทำกันไว้ ตอนนั้นฉันร่างเสร็จฉันก็ได้ทำ Index เอาไว้ โอ็ย เหนื่อยยากเหลือเกิน นี่แน่ะฉันจะให้อาจารย์ดูแต่ละมาตรา ๆ ฉันเอาไว้หมด” ...

This “Phraya Man’s Index”, however, was not made public until it has been finally published as an appendix to the following centennial publication compiled by the Bangkok University in 1990:

This table of the foreign provisions and other sources was titled "ที่มาของกฎหมายในประมวลกฎหมายแพ่งและพาณิชย์ บรรพ ๑ – ๕". Later, it was also published as an appendix when the interview “บันทึกคำสัมภาษณ์ พระยามานวราชเสวี (ปลอด วิเชียร ณ สงขลา)” was officially published in 2014.

However, it raised a question about the accuracy of particular entries in the table. In any way, there was no possibility to clarify the question until the official documents preserved in the library of the “Council of the State” have been eventually made public as the “Archives of the History of Thai Codification”. The archive “Roll 12-5 (Vol.79)” offers the opportunity to reconfirm the accuracy and inaccuracy of the entries in the “Phraya Man's Index” regarding the provisions of Book I and II (Secs. 1 – 452).
